Introduction

The Contracts and Claims Management in Projects course is designed for professionals involved in the management of contracts, claims, and disputes within project-based environments. This five-day course offers participants a comprehensive understanding of contract management principles, the preparation and administration of project contracts, and the resolution of claims and disputes.   • Key Legal Concepts: Understanding offer, acceptance, consideration, and the principle of mutual agreement.
  • Contract Formation: The process of drafting, negotiating, and executing contracts.
  • Standard Contract Forms: Introduction to common contract forms (e.g., FIDIC, NEC, JCT).
  • Case Study: Review of a project contract and discussion on potential risks and challenges.

Day 2: Contract Administration and Management

  • Roles and Responsibilities in Contract Administration: Defining the roles of project managers, contractors, and legal advisors in contract management.
  • Contract Execution and Monitoring: Tracking progress, ensuring compliance, and making necessary adjustments.
  • Contract Amendments and Variations: How to handle changes in scope, timeline, and costs, and ensure proper documentation.
  • Risk Management in Contracts: Identifying potential risks in contracts and developing strategies to mitigate them.
  • Common Contractual Issues: Understanding delay, disruption, liquidated damages, force majeure, and other common issues in project contracts.

  • Claims Documentation and Evidence: How to gather and present evidence to support a claim, including records, reports, and correspondence.
  • Managing Claims from Both Sides: Best practices for both employers and contractors in submitting, reviewing, and resolving claims.
  • Dispute Resolution Mechanisms: Different methods of resolving disputes, including negotiation, mediation, adjudication, arbitration, and litigation.
  • Case Study: Review of a claim scenario, including the submission, negotiation, and resolution stages.

Day 4: Dispute Resolution and Legal Considerations

  • Dispute Resolution Processes: A deep dive into alternative dispute resolution methods such as mediation, arbitration, and litigation.
  • Legal Framework for Claims and Disputes: Understanding the role of courts, laws, and regulations in contract claims and disputes.
  • Contract Breaches and Remedies: What happens when a contract is breached and how to manage the legal consequences, including damages, termination, and injunctions.
  • Claims in International Projects: Managing claims in cross-border projects and understanding the impact of international laws and conventions.

Day 5: Managing Contract Change and Best Practices
